Section 1 Citation and commencement

These Regulations may be cited as the National Health Service (Licence Exemptions, etc.) Amendment Regulations 2015 and come into force on 1st April 2015.

Section 2 Amendment of the National Health Service (Licence Exemptions, etc.) Regulations 2013

(1) The National Health Service (Licence Exemptions, etc.) Regulations 2013 are amended as follows.

(2) In regulation 1 (citation, commencement and interpretation), in paragraph (2), for the definition of “applicable turnover” substitute —

“applicable turnover” means the amounts, calculated in conformity with accounting practices and principles that are generally accepted in England, which are derived by a person from the provision of health care services for the purposes of the NHS , after deduction of any of the following—

trade discounts, value added tax and other taxes based on such amounts, and

turnover from providing medical services under Part 4 of the 2006 Act, dental services under Part 5 of that Act, NHS Continuing Healthcare and NHS funded nursing care;

(3) In regulation 6 (exemption from the requirement to hold a licence: NHS Continuing Healthcare and NHS funded nursing care), omit paragraph (2).
