Section 1 Citation and commencement

These Regulations may be cited as the Criminal Legal Aid (Remuneration) (Amendment) Regulations 2017 and come into force on 1st December 2017.

Section 2 Amendments to the Criminal Legal Aid (Remuneration) Regulations 2013

(1) Schedule 2 to the Criminal Legal Aid (Remuneration) Regulations 2013 (Litigators’ Graduated Fee Scheme) is amended as follows.

(2) In paragraph 2(7) (application) , in both places it appears, for “10,000” substitute “6,000”.

(3) For the tables following paragraph 8(2) (table of final fees in cracked trials and table of final fees in guilty pleas) substitute the following—

(4) For the table following paragraph 9(2) (table of final fees in trials) substitute the following—

(5) In paragraph 20(1)(b) (fees for special preparation), for “10,000” substitute “6,000”.

Section 3 Transitional provision

The amendments made by these Regulations do not apply to matters in which a determination under section 16 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (representation for criminal proceedings) is made before 1st December 2017.
