Section 1 Citation, commencement and interpretation

(1) These Regulations may be cited as the Higher Education and Research Act 2017 (Transitional and Saving Provisions) (University Title) Regulations 2018 and come into force on 1st April 2019.

(2) In these Regulations “the 2017 Act” means the Higher Education and Research Act 2017.

Section 2 Consent to use “university” in title of institution

(1) The coming into force of section 56 of the 2017 Act (use of “university” in title of institution) is of no effect in relation to an application that falls within paragraph (2).

(2) An application falls within this paragraph if it is an application—

(a) for the Privy Council to exercise its power to give consent under section 77(1) of the Further and Higher Education Act 1992 ;

(b) that was made on or before 31st March 2019.

Section 3 Approval of use of “university” in the title of institution etc

(1) The coming into force of section 57 of the 2017 Act (unauthorised use of “university” in title of institution etc) is of no effect in relation to an application that falls within paragraph (2).

(2) An application falls within this paragraph if it is an application—

(a) for the Privy Council to exercise its power to give approval under section 39(1) or (2) of the Teaching and Higher Education Act 1998 ;

(b) that was made on or before 31st March 2019.
