Section 1 Citation and commencement

This Order may be cited as the Magistrates’ Courts Warrants (Specification of Provisions) (Amendment) Order 2018 and shall come into force on 22nd October 2018.

Section 2 Amendment to the Magistrates’ Courts Warrants (Specification of Provisions) Order 2000

For Article 2 (specified provisions) of the Magistrates’ Courts Warrants (Specifications of Provisions) Order 2000 , substitute—

Specified Provisions

(2) The following provisions are specified for the purposes of section 125A(3) of the Magistrates’ Courts Act 1980—

(a) sections 7(1) and (2) of the Bail Act 1976 ;

(b) sections 1(1)(b) , 13(1), 76(1) , 83(1)(b) and (2) , 86(4) , 97(2) and (3), 97A(3) and 136(1) of the Magistrates’ Courts Act 1980;

(c) section 40(2A) and (3) of the Child Support Act 1991;

(d) paragraphs 4(3) and (5) of Schedule 3 to the Crime and Disorder Act 1998 ;

(e) in the Powers of Criminal Courts (Sentencing) Act 2000 —

(i) sections 1(7) , 104(1)(b) and 123(1)(b) ;

(ii) paragraph 3(2)(b) and paragraph 9C(2)(b) of Schedule 1;

(iii) paragraph 3(1)(b) of Schedule 3 ;

(iv) paragraph 1(1) of Schedule 5 ;

(v) paragraph 7(2) of Schedule 7 ;

(vi) paragraph 6(2) of Schedule 8 (but only where an application is made under paragraph 2(1) of that Schedule);

(f) in the Criminal Justice Act 2003 —

(i) sections 256AC(1)(b) and 256C(1)(b) ;

(ii) paragraphs 7(2)(b) and (4), 8(2)(b) and (4), 13(6) and 25(1)(b) of Schedule 8;

(iii) paragraphs 6(2)(b) and 20(1)(b) of Schedule 12;

(iv) paragraph 8(1)(b) of Schedule 19A ;

(g) paragraphs 5(1)(b) and 20(1)(b) of Schedule 2 to the Criminal Justice and Immigration Act 2008 ;

(h) regulations 41(1) and 42(5)(b) of the Community Charges (Administration and Enforcement) Regulations 1989 ;

(i) regulations 16(3)(a) and 17(5)(b) of the Non-Domestic Rating (Collection and Enforcement) (Local Lists) Regulations 1989 ; and

(j) regulations 47(3)(a) and 48(5)(b) of the Council Tax (Administration and Enforcement) Regulations 1992 .
