Section 1Citation and commencement

(1) This Order may be cited as the Representation of the People (Election Expenses Exclusion) (Amendment) Order 2019.

(2) This Order comes into force on the day after the day on which it is made.

Section 2New general exclusion from the definition of election expenses

In Part 2 of Schedule 4A to the Representation of the People Act 1983 (election expenses: general exclusions), for paragraph 7A substitute—

(7A)

(1) Any matter that is reasonably attributable to the candidate’s disability, to the extent that the expenses in respect of the matter are reasonably incurred.

(2) In this paragraph “disability”:

(a) in relation to a candidate standing for election in England, Wales or Scotland, has the same meaning as in section 6 of the Equality Act 2010 ;

(b) in relation to a candidate standing for election in Northern Ireland, has the same meaning as in section 1 of the Disability Discrimination Act 1995 .

(3) This paragraph does not apply in relation to a local government election in Wales.
