Section 1 Citation, commencement and extent

(1) This Order may be cited as the Misuse of Drugs Act 1971 (Amendment) Order 2023 and comes into force on the twenty-eighth day after the day on which it is made.

(2) This Order extends to England and Wales, Scotland and Northern Ireland.

Section 2 Amendment to the Misuse of Drugs Act 1971

In Part 3 of Schedule 2 to the Misuse of Drugs Act 1971 (which specifies the drugs which are subject to control under that Act as Class C drugs), in paragraph 1(a) after “Nitrazolam (1-Methyl-8-nitro-6-phenyl-4H-[1,2,4]triazolo[4,3-a][1,4]benzodiazepine).” insert—

Nitrous oxide.
