Section 1Name, commencement and application

(1) These Regulations are called the School Teachers (Consequential Amendments) (Wales) Regulations 2004 and come into force on 1 September 2004.

(2) These Regulations apply in relation to Wales.

Section 2Amendment of Further Education Teachers' Qualifications (Wales) Regulations 2002

(1) The Further Education Teachers' Qualifications (Wales) Regulations 2002 are amended as follows.

(2) In regulation 2 omit the definition of “1999 Regulations qualification”, and insert the following definition at the appropriate place —

“school teachers' qualification” (“c ymhwyster athrawon ysgol ”) means a qualification that confers upon persons the status of qualified teachers within the meaning of regulation 5 of the Education (School Teachers' Qualifications) (Wales) Regulations 2004 ;

(3) In regulation 3 substitute for sub-paragraph (a) in each of paragraphs (2), (3) and (4) the following sub-paragraph —

(a) a school teachers' qualification;

Section 3Amendment of the General Teaching Council for Wales (Fees) Regulations 2002

(1) The General Teaching Council for Wales (Fees) Regulations 2002 are amended as follows.

(2) In regulation 3 substitute the words “to be registered by virtue of regulations made under section 134(1) of the Education Act 2002 ” for the words “as a consequence” to the end.

(3) In regulation 4(4) substitute for paragraph (b) the following —

(b) required to be so registered by virtue of regulations made under section 134(1) of the Education Act 2002,

Section 4Amendment of the Education (Induction Arrangements for School Teachers) (Wales) Regulations 2003

(1) The Education (Induction Arrangements for School Teachers) (Wales) Regulations 2003 are amended as follows.

(2) In regulation 2(1) —

(a) insert after the definition of “employer” the following definition —

“employment-based teacher training scheme” (“ cynllun hyfforddi athrawon ar sail cyflogaeth ”) means a scheme established by the National Assembly under regulation 8 of the Education (School Teachers' Qualifications) (Wales) Regulations 2004

(b) substitute for the definition of “graduate teacher” the following definition —

“graduate teacher (“ athro neu athrawes raddedig ”) means a person who was granted an authorisation to teach in accordance with paragraphs 5 to 11 of Schedule 2 to the Education (Teachers' Qualifications and Health Standards) (Wales) Regulations 1999 before 1st September 2004;

(c) substitute for the definition of “qualified teacher” the following definition —

“qualified teacher” (“ athro neu athrawes gymwysedig ”) means a person who satisfies requirements specified in regulations made under section 132 of the 2002 Act ;

(d) substitute for the definition of “registered teacher” the following definition —

“registered teacher” (“ athro neu athrawes gofrestredig ”) means a person who was granted an authorisation to teach in accordance with paragraphs 12 to 18 of Schedule 2 to the Education (Teachers' Qualifications and Health Standards) (Wales) Regulations 1999 before 1st September 2004;

(3) In regulation 6(2)(a)(i), insert after the words “registered teacher” the words “or on an employment-based teacher training scheme”.

(4) In the Welsh language version of regulation 8 (1) and (2), substitute the words “athro neu athrawes gymwysedig” for the words “athro neu athrawes gymwys”.

(5) In Schedule 1 —

(a) for paragraph 17 substitute the following paragraph —

(17) A person who is a qualified teacher by virtue of regulation 5 of, and paragraph 12 of Schedule 2 to, the Education (School Teachers' Qualifications) (Wales) Regulations 2004.

(b) for paragraph 18 substitute the following paragraph —

(18) A person who is a qualified teacher by virtue of regulation 5 of, and paragraph 13 of Schedule 2 to, the Education (School Teachers' Qualifications) (Wales) Regulations 2004.

(c) in paragraph 20, substitute for sub-paragraph (c) the following —

(c) is a qualified teacher by virtue of regulation 5 of, and paragraph 10 of Schedule 2 to, the Education (School Teachers' Qualifications) (Wales) Regulations 2004; and
