Section 1 Title and commencement

(1) The title of this Order is the Monmouthshire (Communities) Order 2021.

(2) For any purpose set out in regulation 4(1) of the Regulations, this Order comes into force on 8 November 2021.

(3) For all other purposes, this Order comes into force at 23:59 hours on the day before the ordinary day of election of councillors in 2022 .

Section 2 Interpretation

(1) In this Order—

“ electoral ward ” (“ ward etholiadol ”) means any area for which councillors are elected to Monmouthshire County Council;

“ existing ” (“ presennol ”), in relation to a local government or electoral area, means that area as it exists immediately before the time and day set out in article 1(3);

“ new ” (“ newydd ”), in relation to a local government or electoral area, means that area as established by this Order;

“ the Regulations ” (“ y Rheoliadau ”) means the Local Government Area Changes Regulations 1976 ;

any reference to a map means one of the 166 maps marked “Map of the Monmouthshire (Communities) Order 2021”, deposited in accordance with regulation 5 of the Regulations, labelled “1” to “166”, and a reference to a numbered map is a reference to the map that bears that number;

where a boundary is shown on a map as running along a road, railway line, footway, watercourse or similar geographical feature, it is to be treated as running along the centre line of the feature;

words and expressions used in this Order have the same meaning as they have in the Local Government Act 1972 as saved, except so far as a contrary intention appears.

(2) The provisions in this Order take precedence over any conflicting provision in any previous statutory instrument made under section 58(2) of the 1972 Act or order made under sections 37(1), 38(1) or 39(1) of the Democracy and Boundary Commission Cymru etc. Act 2013 .

Section 3 Abergavenny, Llanfoist Fawr, Llanover and Llantilio Pertholey — change in community boundaries and consequential changes to electoral arrangements

The part of the community of Llanfoist Fawr shown hatched on Map 1—

(a) is transferred to the community of Abergavenny;

(b) forms part of the community ward of Llanwenarth Citra;

(c) forms part of the electoral ward of Cantref.

Section 4 Abergavenny, Llanfoist Fawr, Llanover and Llantilio Pertholey — change in community boundaries and consequential changes to electoral arrangements

The part of the community of Llantilio Pertholey shown hatched on Map 2—

(a) is transferred to the community of Abergavenny;

(b) forms part of the community ward of Lansdown;

(c) forms part of the electoral ward of Lansdown.

(a) is transferred to the community of Abergavenny;

(b) forms part of the community ward of Priory;

(a) are transferred to the community of Abergavenny;

(b) form part of the community ward of Castle;

(c) form part of the electoral ward of Castle.

Section 8 Cantref and Llanwenarth Citra — change in community ward boundaries and consequential change to electoral wards

The part of the Cantref ward of the community of Abergavenny shown hatched on Map 7—

(a) is transferred to the Llanwenarth Citra ward of the community of Abergavenny;

(b) forms part of the electoral ward of Cantref.

Section 9 Cantref and Grofield — change in community ward boundaries and consequential change to electoral wards

(a) is transferred to the Grofield ward of the community of Abergavenny;

(a) is re-named Pen Y Fal;

(b) forms the electoral ward of Castle.

Section 15 Castle — change of electoral ward name

The electoral ward of Castle as changed by this Order is re-named Pen Y Fal.

Section 16 Priory and Grofield — change in community ward boundaries and consequential change to electoral wards

The part of the Priory ward of the community of Abergavenny shown hatched on Map 14—

(a) is transferred to the Grofield ward of the community of Abergavenny;

(b) forms part of the electoral ward of Grofield.

Section 17 Grofield and Llanwenarth Citra — change in community ward boundaries and consequential change to electoral wards

(a) is re-named Park;

(b) forms the electoral ward of Priory.

Section 20 Priory — change of electoral ward name

The electoral ward of Priory as changed by this order is re-named Park.

Section 21 Abergavenny — community ward electoral arrangements

In the community of Abergavenny, the number of councillors to be elected for the—

(a) Grofield ward is 4;

(b) Llanwenarth Citra ward is 1;

(c) Park ward is 3;

(d) Pen Y Fal ward is 3.

Section 22 Caerwent, Magor with Undy — change in community boundaries and consequential changes to electoral arrangements

The parts of the community of Magor with Undy shown hatched on Map 18—

(a) are transferred to the community of Caerwent;

(b) form part of the community ward of St Brides Netherwent;

(c) form part of the electoral ward of Caerwent.

Section 23 Caerwent and Rogiet — change in community boundaries and consequential change to electoral wards

The new community ward of Caldicot Cross of the community of Caldicot is created which—

(a) comprises the area shown hatched on Map 45;

(b) forms the electoral ward of Caldicot Cross.
