Section 1 Title and interpretation

(1) The title of this Order is the Social Partnership and Public Procurement (Wales) Act 2023 (Commencement No. 3) Order 2025.

(2) In this Order, “ the Act ” means the Social Partnership and Public Procurement (Wales) Act 2023.

Section 2 Provisions coming into force on 21 March 2025

The following provisions of the Act come into force on 21 March 2025—

(a) section 9(5) (public procurement subgroup);

(b) section 21 (public contracts);

(c) section 22(1), (3) and (4) (contracting authorities);

(d) section 23 (public procurement);

(e) section 24(8) (socially responsible procurement duty);

(f) section 25(2) and (3) (socially responsible procurement duty: major construction contracts);

(g) section 26(2) (socially responsible procurement duty: outsourcing services contracts);

(h) section 27 (social public works clauses in major construction contracts);

(i) section 32 (public services outsourcing and workforce code);

(j) section 33 (social public workforce clauses in outsourcing services contracts);

(k) section 43 (guidance);

(l) section 44 (regulations);

(m) section 45 (interpretation of Part 3);

(n) Schedule 1 (contracting authorities).

Section 3 Provisions coming into force on 21 March 2025 to the extent specified

The following provisions of the Act come into force on 21 March 2025 to the extent specified in relation to each such provision—

(a) section 39 (regulations relating to annual socially responsible procurement reports), for the purposes of making regulations under that section;

(b) section 40 (regulations relating to contracts register), for the purposes of making regulations under that section.

Section 4 Provisions coming into force on 30 June 2025

The following provisions of the Act come into force on 30 June 2025—

(a) section 9(1) to (4) (public procurement subgroup);

(b) section 10 (provision of information and advice to the SPC by public procurement subgroup).
