Sch 13 para 4

(1) Subject to the provisions of this Schedule, each member of the panel of chairmen and the lay panel is to hold and vacate office in accordance with the terms of his appointment. (2) The Lord Chancellor may remove a member of either panel (including the President) on the ground of incapacity or misbehaviour. (2A) The Lord Chancellor may remove a person under sub-paragraph (2) only with the concurrence of the appropriate senior judge. (2B) The appropriate senior judge is the Lord Chief Justice of England and Wales, unless— (a) the person to be removed exercises functions wholly or mainly in Scotland, in which case it is the Lord President of the Court of Session, or (b) the person to be removed exercises functions wholly or mainly in Northern Ireland, in which case it is the Lord Chief Justice of Northern Ireland. (3) A member of either panel— (a) may at any time resign office by notice in writing to the Lord Chancellor; (b) is eligible for re-appointment if he ceases to hold office.
