聲請人甲因違反槍砲彈藥刀械管制條例（下稱槍砲條例）等罪案件，認 臺灣高等法院花蓮分院103 年度原上訴字第17 號刑事判決，於該判決 中所適用之槍砲條例第20 條第1 項有關自製之獵槍部分規定、依同條 第3 項規定授權訂定之槍砲彈藥刀械許可及管理辦法第2 條第3 款規定 與野生動物保育法第21 條之1 第1 項規定、第2 項前段規定、原住民 族基於傳統文化及祭儀需要獵捕宰殺利用野生動物管理辦法第4 條第3 項 規定及同條第4 項第4 款等規定，侵害了原住民族之多元文化開展與在 憲法上保障之基本權利，有牴觸憲法之疑義，向司法院聲請解釋憲法。 請問： 原住民族的多元文化開展，在憲法增修條文中已有肯定多元文化之相 關規定。請依司法實務、主要學說論述多元文化國對國家要求之義務。 （20 分） 假設你是甲的辯護律師，在釋憲聲請書上應如何論證：本案甲可以主 張憲法上保障的基本權利為何？該基本權利在憲法上的依據為何？ 究屬個人權利或集體權利？（30 分）
