道路交通管理處罰條例第35 條第4 項前段規定，汽車駕駛人拒絕接受同條第1 項 第1 款酒精濃度測試之檢定者，吊銷其駕駛執照。同條例第67 條第2 項前段規定， 汽車駕駛人曾依前開規定吊銷駕駛執照者，3 年內不得考領駕駛執照。同條例第68 條 第1 項規定，汽車駕駛人因第35 條第4 項前段規定而受吊銷駕駛執照處分時，吊 銷其執有各級車類之駕駛執照。請依司法院大法官解釋意旨，分析上述法律規定是 否合憲？並說明理由。（25 分）
