[Added Act 84/65.] (2) For the purpose of providing its own premises the Board may, out of the building fund established under section 14, and with the approval of the Minister subject to such restrictions as the Minister of Finance may impose, enter into contracts, acquire ana hold movable or immovable property and dispose thereof or otherwise deal therewith: Provided that nothing in this section shall prevent the Board from building or purchasing or otherwise acquiring premises in excess of its requirement and letting such parts of the premises as are in excess thereof on such terms as the Board may deem it fit. (4) The Board may, out of the loan fund established under section 14, grant loans to its officers and servants for the purpose of assisting them to own, build, purchase or otherwise acquire houses for theit living accommodations or those of their families; and the Board may secure such loans by imposing such terms and conditions, including the placing of the properties so acquired on mortgage to the Board, as the Minister of Finance may approve; and in the event of the otfcers and servants being unable to repay the loans, the Board may, subject to the discretion of the Minister of Finance, realise or otherwise dispose of the mortgage.

(3) Menteri boleh membuang atau menggantung kerja mana-mana anggota Lemoaga dan boleh melantik seorang lain sebagai gantinya atau sebagaı ganti mana-mana anggota yang mati, bersara atau yang, pada masa itu, tidak dapat bertindak. (4) Walau apa pun peruntukan subseksyen (1), apabila terdapat sesuatu kekosongan dalam Lembaga, adalah tidak perlu bagi Menteri mengisi kekosongan itu selagi bilangan anggota Lembaga tidak menjadi kurang daripada tujuh orang. (8) Segala perbuatan yang dilakukan oleh Lembaga adalah, walaupun ada apa-apa kekosongan dalam Lembaga itu atau kemudiannya didapati bahawa ada kecacatan dalam perlantikan seseorang yang dikatakan menjadi anggota Lembaga itu, sama sahnya seolah-olah kekosongan atau kecacatan demikian tidak wujud. (9) Tertakluk kepada seksyen ini, Lembaga hendaklah mempunyai kuasa untuk mengawalselia prosedurnya sendiri dalam mesyuaratnya dan bagi melantik seorang Setiausaha Lembaga dan bagi mengadakan peruntukan mengenai pengambilan dan penjagaan minit mesyuarat Lembaga. (1) Meterai biasa Lembaga hendaklah mengandungi sesuatu rekabentuk yang diluluskan oleh Lembaga dan Lembaga boleh dari semasa ke semasa memecah, menukar, mengubah dan membuat baru meterai itu sebagaimana yang difikirkannya patut. (2) Meterai biasa Lembaga hendaklah disimpan dalam jagaan Pengerusi dan tidak boleh dicapkan pada mana-mana suratcara kecuali di hadapan Pengerusi dan dua orang anggota Lembaga yang lain, yang hendaklan menurunkan tandatangan mereka pada suratcara itu sebagai tanda kehadiran mereka dan penandatanganan itu hendaklah menjadi bukti yang memadai bahawa meterai itu telah dicapkan dengan sempurna dan betul dan bahawa meterai itu adalah meterai Lembaga yang sah di sisi undang-undang. (1) Lembaga boleh melantik mana-mana pegawai dan pengkhidmat yang difikirkannya perlu bagi pelaksanaan wajar tugas dan fungsi Lembaga. (3) Tiap-tiap anggota, pegawai atau pengkhidmat Lembaga hendaklah disifatkan sebagai seorang N.M.B. pengkhidmat awam dalam erti Kanun Keseksaan. '4) Lembaga boleh, daripada kumpulan wang [Tam. (1) Subject to this Act it shall be lawful for the Board, its members, officers and servants, notwithstanding any other written law to the contrary, to hold, promote, organise and administer such public lotteries as the Board may be permitted to promote under subsection (2) and to write, print, publish, advertise, sell or distribute tickets or chances in any such lottery and to do all such other things as may be incidental to or necessary for the promotion or administration thereof. (2) The Minister may, from time to time, by order permit the Board to promote a public lottery. (1) The Board shall, upon the promotion of any Proopetys lottery under this Act, cause to be published in the Gazette, or in such other manner as the Minister may to blished. direct, a prospectus of such lottery which shall set Lm.Ac forth (a) the prizes offered therein; (b) the number of tickets or chances therein to be • offered for sale and the prices and denomina- •tions of such tickets or chances; (c) the opening and closing dates for the sale of tickets or chances therein; (a) the times, places and manner at or in which the winners of prizes therein will be determined; (e) the conditions subject to which any tickets or chances therein will be offered for sale and in accordance with which such lottery will be conducted; (f) such other matters as may be prescribed. (2) No tickets or chances in any lottery shall be sold or distributed at any time before the expiration of a period of one month after the date of the publication of such prospectus relating thereto.

(1) No tickets or chances in any lottery promoted by Tickets and the Board under this Act shall be sold or distributed chances in a lottery to be otherwise than on behalf of the Board and either— sold, etc., only through (a) by a person authorized in writing in that behalf the Postal by the Director General of Posts and at a Post Services. [Sub.F.M. Office or through a Postal Agency established Ord. under the Post Office Act, 1947; or 63/51;Am. P.U.(B) (b) by a person authorized in writing in that behalf 324|70.] Act 211. by the Chairman of the Board and at such place or places as the Chairman of the Board may, by notification in the Gazette, specify. (2) Any person who sells or offers for sale or distributes or attempts to distribute or who buys or offers to buy or obtains or attempts to obtain any ticket or chance in a lottery in contravention of subsection (1) or who is found without lawful excuse in possession of any ticket or other document entitling any person to a chance in such lottery which has been • bought or obtained in contravention of such subsection shall be guilty of an offence against this Act. (1) All sums raised by any lottery, the prospectus of which was issued under this Act shall, subject to the following deductions, that is to say— (a) the amount paid out of the said lottery as prizes; (b) the payment of duties under section 20; (c) all costs, charges and expenses incurred by the Board in the promotion and administration of the said lottery; (d) any sum paid into the Reserve Fund established under section 13; (e) such amounts in respect of the general administrative or other expenses incurred by the Board in carrying out its functions under thinisct, as, subject to the approval of the Minister Finance, it may think reasonable; and (f) any sums paid into the building or loan funds established under section 14, be paid into and form part of the Consolidated Fund. (2) There shall in each year be made, out of moneys appropriated by Parliament, payments, tor the purposes hereinatter specified, of aggregate amounts equalling, taking one year with another, the amounts paid into the Consolidated Fund under subsection (1). (3) It the Board is dissolved, the balance of the Reserve Fund, after payment of all liabilities of the Board, shall be paid into and form part ot the Consolidated Fund and subsection (2) shall apply to amounts paid into the Consolidated Fund under this subsection as they apply to amounts paid into that Fund under subsection (1). (4) The payments made under subsection (2) may be made for the purposes of giving ald to any publlc philanthropic, charitable, religious or educational organisation, institution or body or of carrying out any philanthropic, charitable, religious or educational scheme or project or any work beneficial to the public, or for the improvement of the social condition, or for the advancement of the welfare, of the public or any class thereof. (1) The Board may establish a Reserve Fund, of Reserve such amount as the Minister of Finance may approve, for the purpose of meeting any present, future or contingent liabilities incurred or likely to be incurred by the Board in carrying out its duties under this Act ot in promoting or administering any lottery which it is or may be permitted to promote under this Act, ana may pay into such Fund from time to time, subject to tne approval of the Minister of Finance, out of any sums received by it in respect of any lottery such sums as may be necessary for the maintenance of such Fund at the approved amount. (1) The Board may, out of the moneys raised by each lottery, establish the following funds- (a) a building fund to be expended for the purpose of owning, building, purchasing or otherwise acquiring its own premises in accordance with section 3; and (b) a loan fund to be expended for the purpose of granting housing loans to its oincers and servants in accordance with section 6. (2) Each fund shall be of such amount as may be approved by the Minister of Finance, and the Board may, out of the moneys raised by each lottery, pay into each fund such sums as may be determined by the Minister. (1) No lottery shall be promoted or administered by the Board otherwise than in accordance with this Act and of any rules made thereunder relating thereto, and of the terms and conditions of the order made under section 7 permitting such lottery, or otherwise than in accordance with the prospectus relating to such lottery published by the Board under the provisions of section 8. (2) Any member, officer, servant or agent of the Board acting or attempting to act in contravention of the provisions of this section shall be guilty of an offence against this Act. (3) Any person abetting the commission of an offence under subsection (2) shall be guilty of an offence against this Act. Other

Any person who- (a) sells or distributes or permits to be sold or distributed any ticket or chance in any lottery promoted by the Board otherwise than in accordance with this Act or of any rules made thereunder relating to such lottery or with the provisions of any order or prospectus relating thereto; (b) being an agent, officer or servant of any person fails to account to his principal for any sums received on sale or by commission or otherwise in respect of the sale or distribution of any such ticket or chance; or (c) with intent to deceive, makes any false entry or omits to make any entry required to be made in respect of any lottery in any book required under this Act to be kept in respect of such lottery, shall be guilty of an offence against this Act and shall, on conviction, be liable to a fine not exceeding five • thousand ringgit, or to imprisonment for a term not exceeding two years, or to both. The Yang di-Pertuan Agong may make rules- (a) prescribing anything required to be or which may be prescribed under this Act; (b) regulating the conduct and administration of any lottery promoted under this Act including the sale and distribution of tickets or chances. the form, printing and serial numbering of such tickets or chances, the drawing of prizes, the commission (if any) to be paid on the sale oi (c) prescribing the manner in which accounts required under this Act shall be kept and audited; (d) prescribing any other matter which may be necessary tor the purpose oi carrying this Act into etiect and for the purpose of ensuring the honest and satistactory management of any lottery promoted under this Act and the due application of all funds raised by such lottery.
