對商業性言論之事前審查是否合憲？試就大法官歷來解釋之意旨及審查基準論述 之。（25 分）

最高行政法院97 年度裁字第3600 號裁定稱：「公立學校係各級政府依法令設置實施 教育之機構，具有機關之地位，業經司法院釋字第382 號解釋在案。是以公立學校 聘用教育從事學術研究、教育工作，實具有公法法律關係之性質，公立學校教師之 法律地位應等同公務人員，與公立學校自具有公法上勤務關係，為特別權力關係之 範疇。從而教師對公立學校之措施，如有不服，得否提起行政訴訟，依上述說明， 自應以該措施是否足以影響其教師身分，或是否對其有重大影響以為斷；苟該措施 並未影響其教師身分，或未發生重大影響者，則應認屬公立學校內部之管理行為， 而非對外發生法律效果之行政處分，自不得對之提起行政訴訟。」請依大法官相關 解釋之精神，論述最高行政法院此一裁定是否合憲？（25 分）
